These General Terms and Conditions (GTC) govern the contractual relationship and the use of the technologies, software solutions and technical tools offered by xaxada AG and via the senior.help platform.
§ 1 Scope & Provider Information
1. The following General Terms and Conditions (GTC) apply to all contracts, deliveries and services of xaxada AG (Chappelenmatt 18, 6062 Wilen-Sarnen OW, Switzerland) as well as to the offer under the domain www.senior.help.
2. xaxada AG and senior.help act solely as providers of technology and technical aids. They do not provide any medical, nursing, or care services.
§ 2 Subject of the contract & operational availability
1. The subject of the offer is the provision of specialized technical aids and systems.
2. No guarantee can be given for the uninterrupted, trouble-free, or permanent operation of the provided systems, servers, and devices. Service interruptions due to technical malfunctions, maintenance work, or disruptions in third-party networks are expressly reserved.
§ 3 Personal responsibility of patients and relatives
1. Patients, customers and their relatives are and remain fully responsible at all times for themselves and for the people in their care and those in need.
2. The use of technical aids from xaxada AG and senior.help does not in any way release relatives, caregivers, support persons or supervisors from their personal duty of care, support, nursing and supervision.
§ 4 Duty of inspection of customers and relatives
The technical aids developed and offered by xaxada AG and senior.help serve only as support tools. The customer, as well as their relatives or caregivers, are obligated to regularly and independently check the functionality of the devices and systems used to ensure they are working correctly (e.g., checking power supply, battery level, signal connection, alarm activation, and hardware condition).
§ 5 Exclusion of Warranty and Guarantee
To the extent permitted by law, xaxada AG and senior.help expressly disclaim all warranties and guarantees regarding the functionality of the provided technical aids and software solutions. No assurance or guarantee is given for 100% reliability in an emergency or for uninterrupted signal transmission.
§ 6 Disclaimer
xaxada AG and senior.help are not liable for damages, personal injury or consequential damages resulting from a malfunction, signal failure, omission or delayed notification or incorrect operation of the devices, unless these are due to intentional or grossly negligent conduct on the part of xaxada AG.
§ 7 Applicable Law & Jurisdiction
Swiss law applies exclusively. The place of jurisdiction for all disputes arising from or in connection with these terms and conditions is – to the extent legally permissible – the registered office of xaxada AG in Sarnen OW, Switzerland.
